Agreement
These Terms of Service (“Terms”) govern your access to and use of Nestify at yournestify.com and related services. By creating an account or using Nestify, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
What Nestify provides
Nestify is a technology platform that helps users search for homes, save searches, receive alerts, compare properties, and submit listings in New Jersey and New York. Nestify is not a real estate broker, agent, lender, or attorney. We do not represent buyers or sellers in transactions. Information on Nestify—including AI-generated summaries, scores, and estimates—is provided for general informational purposes only and should not be relied on as legal, financial, or professional advice.
Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old to use Nestify. We may suspend or terminate accounts that violate these Terms or pose a security risk.
Acceptable use
You agree not to misuse Nestify, including by scraping or bulk-downloading MLS data without authorization; attempting to access accounts or systems you do not own; posting false, misleading, or fraudulent listings; harassing other users or our team; circumventing access controls or rate limits; or using the service for unlawful purposes. We may remove content and restrict access at our discretion.
User-submitted listings
If you submit a property listing, off-market lead, luxury submission, or investor deal, you represent that you are the owner or are authorized to provide the information, that the information is accurate to the best of your knowledge, and that you have the right to share any photos or materials uploaded. Nestify may review, edit, reject, or remove submissions. Listing a property on Nestify does not guarantee exposure, leads, or a sale. For FSBO and direct-owner listings in NJ and NY, you are responsible for required disclosures, including Property Condition Disclosure and flood-risk disclosures where applicable. We recommend consulting a licensed real estate attorney before signing contracts.
Subscriptions and payments
Some features require a paid subscription processed through Stripe. Fees, billing cycles, and plan details are shown at checkout. Subscriptions renew automatically unless canceled before the renewal date. You can manage or cancel through your account billing portal where available. Refunds are handled according to the policy shown at purchase unless required otherwise by law.
Intellectual property
Nestify, its branding, software, and original content are owned by Nestify or its licensors. MLS listing photos, remarks, and data remain the property of their respective owners and are displayed under applicable MLS rules. You retain ownership of content you submit but grant Nestify a license to host, display, and promote that content in connection with the service.
Disclaimers
Nestify is provided “as is” and “as available.” We do not warrant that listing data is complete, current, or error-free; that AI search results will match your expectations; or that the service will be uninterrupted. MLS data, third-party integrations, and user submissions may contain inaccuracies. Always verify property details, pricing, taxes, HOA rules, school assignments, and legal status independently before making decisions.
Limitation of liability
To the fullest extent permitted by law, Nestify and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities arising from your use of the service. Our total liability for any claim related to Nestify will not exceed the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold Nestify harmless from claims arising out of your use of the service, your listings or submissions, your violation of these Terms, or your violation of any third-party rights.
Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
Changes and contact
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance. Questions: content@yournestify.com.
